Melissa Gilbert was visibly emotional in a New Mexico courtroom as a surprising decision unfolded. Judge David Murphy ruled that her husband, actor and director Timothy Busfield, would be released ahead of trial on his own recognizance\u2014provided he followed strict court conditions.<\/p>\n\n\n\n

The judge emphasized that Busfield had not violated any laws and could be released as long as he complied with all future court appearances and restrictions. These include supervision by pretrial services in Albuquerque, no contact with alleged victims or minors under 18, abstaining from alcohol and illegal drugs, avoiding weapons, and keeping the court updated on any changes to his address. Gilbert, married to Busfield for more than a decade, struggled to hold back tears as the ruling was read\u2014a reaction highlighting the uncertainty surrounding the case, especially after prosecutors urged the court to keep Busfield in custody. The state raised concerns about past allegations, including claims from actress Claudia Christian that Busfield forcibly grabbed her on a film set years ago. Prosecutors also noted that Busfield delayed turning himself in, traveling thousands of miles and taking a polygraph before surrendering.<\/p>\n\n\n\n

Prior to his arrest, Busfield underwent a psychosexual evaluation requested by his legal team, assessing his risk of committing sexual offenses. Evaluators considered his personal history, employment, and family support, noting that both Busfield and Gilbert described their relationship as loving and supportive. The report characterized him as \u201cvery low risk,\u201d highlighting his honesty during the evaluation, consistent work history, and involvement in positive social activities.<\/p>\n\n\n\n

The court also received over 75 letters of support, including multiple from Gilbert. She praised Busfield as her \u201clove\u201d and \u201crock,\u201d emphasizing his character, compassion, and moral integrity. Others who submitted letters included Busfield\u2019s stepson and former co-stars Ken Olin and Peter Horton.<\/p>\n\n\n\n

Busfield faces serious charges related to allegations that he inappropriately touched two 11-year-old twins on the set of The Cleaning Lady<\/em>. The complaint alleges the incidents began in 2022 and continued until 2024. Following his arrest on January 13, Busfield denied the claims and vowed to fight the charges. He is currently charged with two counts of criminal sexual contact of a minor under 13 and one count of child abuse. Conviction on all counts could carry up to 15 years in prison.<\/p>\n\n\n\n
