Judge Issues Ruling on Timothy Busfield, Melissa Gilbert Reacts Emotionally

Melissa Gilbert was visibly emotional in a New Mexico courtroom as a surprising decision unfolded. Judge David Murphy ruled that her husband, actor and director Timothy Busfield, would be released ahead of trial on his own recognizance—provided he followed strict court conditions.

The judge emphasized that Busfield had not violated any laws and could be released as long as he complied with all future court appearances and restrictions. These include supervision by pretrial services in Albuquerque, no contact with alleged victims or minors under 18, abstaining from alcohol and illegal drugs, avoiding weapons, and keeping the court updated on any changes to his address. A trial date has not yet been set.

Gilbert, married to Busfield for more than a decade, struggled to hold back tears as the ruling was read—a reaction highlighting the uncertainty surrounding the case, especially after prosecutors urged the court to keep Busfield in custody. The state raised concerns about past allegations, including claims from actress Claudia Christian that Busfield forcibly grabbed her on a film set years ago. Prosecutors also noted that Busfield delayed turning himself in, traveling thousands of miles and taking a polygraph before surrendering.

Despite these objections, Judge Murphy deemed supervised release appropriate.
